Returns will only be accepted if authorised by RVM Australia or its authorised agent and RVM Australia is notified within seven days of receipt of goods that there is a problem with the goods supplied. Goods may only be returned via a carrier approved by RVM Australia. A handling charge may apply to returned goods. It is at RVM Australia's absolute discretion to apply a credit on returned goods.
The risk of ownership of the goods supplied under this agreement shall pass to the applicant upon delivery. Goods not paid for in full remain the property of RVM Australia. Until full payment is made, the applicant shall not sell, transfer or assign ownership of those goods to another party.
The applicant must seek RVM Australia's consent prior to advertising any product supplied under this application — for all forms of advertising including websites and online advertising. The applicant acknowledges and agrees not to advertise any RVM Australia product below the recommended retail price unless prior approval has been received.
Goods will not be supplied where an account is overdue. RVM Australia reserves the right to charge interest on overdue accounts at the rate charged by Westpac Bank in Perth on overdrafts of $100,000.00 plus 3 percent. Any legal fees and expenses incurred in the recovery of outstanding debts will be for the account of the applicant.
The applicant agrees to charge its respective interests in any real property as security for individual performance of the terms of this agreement, and authorises RVM Australia to lodge a caveat against the title of any such real property for that purpose.
All parties consent to the jurisdiction of any court in Western Australia. Any cause of action which may arise between the parties is said to arise within the jurisdiction of Western Australia.
The applicant undertakes to advise RVM Australia of any changes of ownership, address or any material changes to the business.
I/We have read and understand the trading terms. I/We have taken independent legal and financial advice in relation to the personal guarantee. I/We personally guarantee payment of all accounts for goods purchased. I/We confirm liability for any legal costs and penalty interest incurred in collection. I/We understand this guarantee binds us jointly and severally.
